Labor conflict management
The books and articles presented at the exhibition substantiate various approaches to the concept of "labor conflict", analyze labor conflicts of various scales, as well as possible solutions to conflict situations. The research of the Scientific Monitoring Center of the St. Petersburg Humanitarian University of Trade Unions, literature on labor disputes, as well as educational literature are presented separately.
The publications can be useful to heads of enterprises, chairmen and activists of trade union organizations, employees of personnel services, lawyers, students and postgraduates studying problems of regulation of social and labor relations, as well as anyone interested in topical issues of social partnership.
During the preparation of the exhibition, monographs and journal articles from the collections of the Russian National Public Library for Science and Technology, as well as online publications from electronic library systems were used "Znanium.com ", "Book.ru ", "IPRbooks", scientific electronic libraries "Elibrary.ru " and "Cyberleninka.ru ", open source Internet. The editions are arranged alphabetically.

Abstract: The article-by-article commentary to the Labor Code of the Russian Federation has been prepared by leading Russian scientists in the field of labor law on the basis of a scientific analysis of the current labor legislation and its application practice. The author's team of the Department of Labor Law and Social Security Law of the Kutafin Moscow State Law University (MSLA) has a long tradition in commenting on labor legislation. The commentary has been revised and supplemented taking into account the amendments made to the Labor Code of the Russian Federation, as well as federal laws and other regulations containing labor law norms adopted in the period after the previous edition. When preparing the commentary, the norms of international labor law and judicial practice were widely used. Regulatory legal acts are listed as of February 1 , 2018 .

Abstract: In the modern world, labor conflicts are an integral part of social and labor relations. Official statistics record only that part of the conflicts that turned into strikes, taking into account the number of workers who took part in it and the loss of working time. Scientific institutes and research centers dealing with this issue, considering the issue more broadly, collect more detailed data. The presented work analyzes various sources of information about labor conflicts in Russia over the past few years. As the results, the main trends over the past three years have been identified and the possible causes have been assessed, the main regulatory measures have been proposed, taking into account the role of the state and trade unions.

Abstract: The study of this topic is quite relevant, since it is necessary to theoretically substantiate and develop a number of methodological approaches in order to prevent and resolve labor conflicts at all hierarchical levels of enterprise management, as well as in relations with the state, which, in turn, does not pay enough attention to creating favorable conditions for resolving constantly arising labor conflicts. All conflicts arising within the framework of social and labor relations are often destructive, and inattention to them and their resolution can lead to serious consequences, even before the destruction of the effective functioning of the entire organization, which is why the settlement of these conflict situations is an extremely important function of management. In this regard, the question of choosing the optimal strategy becomes quite important – a strategy that would allow us to come to a resolution and an end to the conflict.

Abstract: Labor conflicts are a kind of social conflicts, the object of which is labor relations and the conditions for their provision. Most often, labor conflicts are associated with negative consequences. However, conflicts can be manageable and completely solvable. Labor conflict management is one of the main functions of a modern manager and is a purposeful impact on eliminating (minimizing) the causes that gave rise to the conflict, or on correcting the behavior of participants in the conflict (employer and employee). In this article, the author considered such key points as the prevention and prompt resolution of labor conflicts arising in the organization. The main mechanisms for managing labor conflicts are proposed, which contribute to reducing their number, reducing social tension in the labor collective and increasing labor productivity, i.e. the formation of positive consequences of labor conflicts. The article will be of interest to both graduate students and applicants of the "labor economics" direction, as well as personnel services employees and labor dispute lawyers.

Then comes the time of three more stages of the conflict (development, outcome and consequences).

Abstract: The article analyzes the essence of the mediation procedure and its applicability to labor disputes, reveals the advantages of this method of conflict resolution in the labor sphere, and also identifies some problems of its implementation. In the work, the authors highlight the main positive features of mediation, which consist in its confidentiality, voluntariness, short terms for making a decision on a dispute, as well as the ability to come to a decision, to a common solution that suits both sides. The question is raised about the difference between the resolution of a dispute in the labor dispute commission and the mediation procedure. Based on the results of the study, the authors conclude that the inclusion of mediation in the system of settlement of labor disputes meets the goal of increasing the stability of labor relations and encourages employees and employers to find a balance of interests.

Abstract: On the basis of formal-logical and comparative-legal methods, the analysis of Russian legislation in the field under consideration was carried out, as well as the experience of legal regulation and practice of mediation in collective labor disputes abroad was studied. The geographical scope of the study covers mainly Europe, North America and China. Based on the results of the analysis of the situation, the author presents the advantages that the use of mediation in the settlement of collective labor disputes will give, and the ways to eliminate the obstacles to this are indicated. It is concluded that it is necessary to amend the Labor Code of the Russian Federation and the Federal Law "On an alternative dispute settlement procedure with the participation of an intermediary (mediation procedure)", which would eliminate the excessive restriction established by law regarding the application of mediation to social partnership relations in the field of labor.
